The trial in the case is yet to begin.
Khalid and Imam have challenged the September 30 order of the Delhi High Court denying them bail.
The High Court had said that it was “bound by judicial discipline” and could not modify conditions imposed by the Supreme Court in its January 5 order concerning the activists.
In January, the Supreme Court denied bail to Khalid and Imam, but granted relief to activists Gulfisha Fatima, Meera Haider, Shifa-Ur-Rehman, Muhammad Saleem Khan and Shadab Ahmed.
The top court had said that Imam and Khalid could renew their bail petitions after the examination of protected witnesses was completed or after one year, whichever came earlier.
Khalid and Imam “stand on a qualitatively different footing as compared to other accused”, the Supreme Court had said at the time.
On May 18, a Supreme Court bench criticised the January order, observing that “bail is the rule and jail is an exception” even in prosecutions under the anti-terror law.
In his petition, Imam stated that despite spending six years and nine months in jail as an undertrial, the prosecution has failed to examine even one of the 47 protected witnesses, Live Law reported.
