Per a Yahoo! Sports report Tuesday, Oct. 27, a federal judge in Alabama has designated Nov. 18 as the hearing date in Birmingham, Alabama.
The SEC filed a lawsuit against LSU in federal court in Alabama more than a month ago, citing its desire to establish its First Amendment rights as a free and expressive association and that LSU football and men's basketball program's actions at the time of attempting to roster former professional athletes were in direction violations of league's rules.
LSU President Wade Rousse, Athletics Director Verge Ausberry, LSU football coach Lane Kiffin and Louisiana Attorney General Liz Murrill are named as defendants on the motion that also include every member of the LSU Board of Supervisors.
Both sides have traded replies over the last couple of weeks in the ongoing legal saga. LSU has filed twice that the lawsuit be dismissed, arguing in its filings that the SEC has failed to pinpoint a constitutional violation and that because LSU football never rostered Dae'Quan Wright and Zxavian Harris.
And since the SEC's updated responded on Oct. 13 to the lawsuit was filed, LSU basketball coach Will Wade has never rostered RJ Luis, that the conference's concerns never materialized. During his SEC Media Days appearance earlier this month, Wade told reporters that his program was going to abide what the SEC tells them to do in regards to player eligibility.
"The Court should ignore that Hail Mary," LSU's latest response said.
LSU further argued that sovereign immunity, improper venue and the absence of a viable First Amendment complaint warranted dismissal of the case.
